Part 1. Provisions for private users

This part of the privacy policy applies to private users of WestaSoft services. The legal basis for processing your data is based on your consent given in this privacy policy as consent or to be able to provide you with requested information or products according to GDPR Article 6 para.1 lit.b).

If you have agreed to our privacy policy and provided us with your phone number during a consultation request, we will contact you by phone before forwarding your consultation request to our partner company to verify the accuracy of your information, discuss your project, and connect you with the appropriate sales and craft partner.

Information about the transfer of your data and evaluation

If you have agreed to our privacy policy and provided us with your email address during a consultation request, we will inform you via email about the current status of your consultation request through our service. This includes sending you a message with the contact details of the referred specialist partner and providing you with an opportunity to evaluate this specialist company after your consultation. Use of personal data when registering for events or informational visits

On some pages of our website, you have the opportunity to enter personal data to register for informational visits, our training sessions, or events. We will only use this data to process your request. If you enter your email address and phone number as a participant in one of our events, you will receive a confirmation email and, depending on the event, an SMS 30 minutes before your time slot / before the start of your event. III. Provisions for Applicants

This part of the data protection regulations applies to applicants for job advertisements from companies of the West Group or third-party companies to whom we provide a platform or partner program for job advertisements/placement. This only applies insofar as these applicants transmit personal data to us within the framework of the application process, e.g., application in paper form, email, contact forms with attachments, or through the West Group-operated portals or the use of third-party electronic job boards according to the required contents, also in accordance with further national legal requirements, to us. Application documents submitted on paper are scanned and stored in our systems, and the paper is then disposed of in compliance with data protection regulations via certified service providers.

We only use your personal data to process your application and based on the consent in this privacy policy. The personnel responsible for the West-HoldingManagement GmbH, the respective group company, as well as supervisors or other recruiting officers in whose area the position is advertised, have access to your documents. Another form of processing takes place anonymously for the purpose of measuring the success of the job placements and the technical application channels used, as well as, also anonymously, the skills transmitted by applicants.

The processing of the data is carried out using systems of Infoniqa Payroll Holding, a company based in Böblingen. The West Group has accordingly Article 46 GDPR with Infoniqa Payroll Holding concluded a contract based on the EU standard data protection clauses.

The deletion of stored personal data of the applicant occurs automatically at the earliest after 4, but at the latest after 6 months, from the time the applicant is informed that the position will not be filled by them and no other legal requirements prevent this. The period results from the requirements of the General Equal Treatment Act. Only with your explicit consent upon our inquiry will your data remain stored in our system to be considered for future other job advertisements.

When submitting application documents in paper form without reference to job advertisements in our electronic formats, e.g., as an unsolicited application, you will receive a summary of this privacy policy along with an acknowledgment of receipt of your letter or at the latest upon rejection by us.   


IV. General Information and Provisions, Websites and apps

These provisions apply in addition to the provisions for private users and the provisions for business users for the websites and apps of CARBONIT, ERO and Westaflex. For our apps there are partly additional own privacy policies. The privacy policy of our apps can be found in the respective App-Store (iTunes, Google Play).

Data processing by accessing our websites and using our apps

The West Group automatically collects and stores information in its server log files that your browser or the App transmitted to us. This data cannot be assigned to individual persons by us. A combination of this data with other data sources is not carried out. These are:

Time of the server request

The IP address is the globally valid, at the time of allocation by your internet provider, unique identification of your computer and consists, in its most common form (IPv4), of four number blocks separated by dots, or extended by additional digits (IPv6). As a private user, you will usually not use a constant IP address, as this is only temporarily assigned to you by your provider (so-called 'dynamic IP address'). In the case of permanently assigned IP addresses (so-called 'static IP address'), a clear assignment of user data via this feature is technically easily possible.

The mentioned data is processed by us for the following purposes:

The personal data of the server log files are processed based on Art. 6 para. 1 lit. f GDPR. This legal basis permits the processing of personal data within the framework of the 'legitimate interest' of the controller, as long as your fundamental rights, freedoms, or interests do not prevail. Our legitimate interest lies in easier administration and the ability to detect and track hacking. You can object to this data processing at any time if there are reasons that exist in your particular situation and speak against the data processing. An email to the corporate data protection officer is sufficient for this. Our legitimate interest follows from the purposes for data collection listed above. In no case do we use the collected data to draw conclusions about your person.

The server log files with the above-mentioned data are automatically deleted after 30 days or anonymized in case of use for statistics. We reserve the right to store the server log files longer if there are facts that suggest an unauthorized access (such as an attempt of hacking or a so-called DDOS attack) suggest.

Linking to external websites

This privacy policy applies exclusively to our websites and apps. These may contain links to third-party web offers. This privacy policy does not extend to these. If you leave the WestGroup websites and apps, to visit a third-party provider's offer, we recommend also carefully reading the privacy policy of this provider.

Information on cookies and use of analysis tools

The processing of personal data through cookies and analysis tools (list all analysis tools) is based on Art. 6 para. 1 lit. f GDPR. This legal basis permits the processing of personal data within the framework of the 'legitimate interest' of the controller, as long as your fundamental rights, freedoms, or interests do not prevail. Our legitimate interest lies in analyzing the use of our website.

Die Verarbeitung of personenbezogenen Daten durch Alphabet AdWords, (list all retargeting technologies) is based on Art. 6 para. 1 lit. f GDPR. This legal basis permits the processing of personal data within the framework of the 'legitimate interest' of the controller, as long as your fundamental rights, freedoms, or interests do not prevail. Our legitimate interest lies in the personalized display of targeted advertising and the statistical analysis of the effectiveness of the advertising (e.g., determining how many clicks on an advertising banner led to a purchase on our website).

The companies of West Group use on their websites and in their apps so-called cookies in several places. They serve to make our offering more user-friendly, effective and secure. Cookies are small text files that are stored on your computer and that your browser saves. Most of the cookies we use are so-called “session cookies”.
